Independent Geriatric Pharmacist & Forensic Pharmacology Expert Witness

David Lee, Pharm.D., Ph.D.

Yale-Trained Clinical Epidemiologist, Clinical Pharmacologist, & Geriatric Pharmacist

When an older adult suffers a catastrophic fall, sudden confusion, or unexpected decline, medical records usually blame "dementia" or "old age." But thousands of pages of chart notes often hide a different story: prescribing errors, dangerous drug interactions, and preventable drug toxicity.

I help plaintiff and defense trial attorneys find the clinical pharmacology evidence hidden in complex medical records—and explain it in plain English that judges and juries actually understand.

Wealth managers, did you know:

Medications can threaten cognitive capacity. Are you sure it’s not threatening their financial futures?

How I Help Your Case

1. Fall Causation & Polypharmacy

Did a patient trip because of unsteadiness, or did a late-day blood pressure med, diuretic, and sedative combination cause sudden orthostatic hypotension? I review dosing, administration timing, and drug interactions to determine if medication directly caused the fall.

2. Medication-Induced Delirium vs. Dementia

Over-the-counter sleep aids (like Benadryl or Tylenol PM) and common prescription drugs carry high anticholinergic burden. They block memory neurotransmitters and cause sudden delirium that looks identical to rapid dementia progression. I isolate whether brain function was destroyed by disease or suppressed by drugs.

3. Prescribing Cascades & Medical Malpractice

When a physician treats the side effect of Drug A by prescribing Drug B, and then adds Drug C to fix Drug B, the patient ends up over-medicated and injured. I track the timeline to show where the standard of care broke down and where drug toxicity took over.

4. Nursing Home Over-Medication & F-Tag Compliance

I evaluate nursing home records for improper chemical restraints, unmonitored psychotropic medications, and regulatory violations that lead to preventable harm, elder abuse claims, or wrongful death.

Why My Testimony Stands Up in Court

Active Clinical Practice:

I actively treat patients in my own practice at MyRxPro and work directly with families. My opinions are grounded in real-world patient care today.

Deep Scientific Authority:

I hold a PharmD, a PhD in Clinical Pharmacology/Pharmacokinetics/Pharmacodynamics, and completed a Postdoctoral Fellowship in Geriatric Clinical Epidemiology at the Yale University School of Medicine. I spent nearly a decade as an Assistant Professor researching fall risks and published 17+ peer-reviewed studies.

Clear Courtroom Translation:

As the author of Fewer Pills, More Paws: Caring for Your Aging Parents and Lessons from Our Pets, my entire career is built on explaining complex medical science without textbook jargon. I make drug mechanisms simple, logical, and memorable for a jury.

How We Work Together

Step 1: 48–72 Hour Preliminary Merit Screen

Don't waste thousands of dollars on full discovery before you know if the pharmacology supports your case. Send me the core medical chart, and I will give you a fast, direct answer on whether drug causation exists.

Step 2: Comprehensive Expert Report

If the case has merit, I build a clear, step-by-step causation report using established clinical scales (AGS Beers Criteria®, Naranjo Causation Algorithm) that strengthens your settlement negotiations or trial prep.

Step 3: Deposition & Trial Testimony

Direct, unflappable, and easy-to-understand testimony designed to withstand intense cross-examination and defend Daubert/Frye challenges.

Request a Preliminary Conflict Check

To maintain professional objectivity, all potential engagements begin with a conflict-of-interest check. Please provide the names of the parties involved and a brief description of the case.

Submission of this form, including any preliminary case details, is for the purpose of a conflict-of-interest check and initial consultation only. Receipt of this information does not establish an expert-client relationship or a provider-patient relationship. An expert engagement is only formalized upon the execution of a signed retainer agreement and the payment of the initial merit review fee.

Clinical Data Integrity & Security

At RxPro Forensics, we understand that confidential records are the most sensitive assets in a legal proceeding. Our security protocol is designed to mirror the rigor of our evidentiary audits:

  • Encryption: Your data is stored with security and confidence with 256-bit encryption.

  • Confidentiality: Dr. David Lee maintains strict privileged confidentiality protocols. Information submitted for a conflict check is viewed only by Dr. Lee to determine case viability and professional alignment.

  • Clinical Administration Records: We specialize in the forensic analysis of Medication Administration Records. All uploaded documents are housed in a secure digital vault, isolated from public-facing servers.

  • Objective Disposal: Upon the conclusion of a matter, all digital and physical case materials are either returned to the retaining party or destroyed via certified clinical shredding/digital wiping protocols.
